Terms Of Service

1. Acceptance Of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and the TERRA operations team (“TERRA”, “we”, “us”, or “our”) governing your access to and use of the TERRA platform, mobile application, APIs, and all related services (collectively, the “Service”).

By connecting a wallet, creating an account, accessing any feature, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 18 years of age to use TERRA. By using the Service, you represent and warrant that:

• You are at least 18 years old and legally capable of entering into a binding agreement in your jurisdiction.
• You are not located in a jurisdiction where participation in blockchain-based applications or holding of digital utility tokens is prohibited by law.
• You are not subject to sanctions administered by any government authority, including OFAC, the UN, or the EU.
• Your use of the Service does not violate any applicable laws or regulations in your jurisdiction.

We reserve the right to verify eligibility at any time and to restrict or terminate access for users who do not meet these requirements.

3. Account And Wallet

TERRA uses a non-custodial wallet authentication model. You access the platform by signing cryptographic authentication messages with your Solana wallet. We do not create, control, or store your private keys or seed phrases.

• You are solely responsible for the security of your wallet and all activity performed through it.
• If your wallet is compromised, lost, or stolen, TERRA cannot recover your account, reverse transactions, or restore rewards.
• You must not share your wallet credentials, private key, or seed phrase with any person or service, including TERRA support.
• You are responsible for all actions taken by any person who gains access to your wallet.
• You agree to notify us immediately at support@terraseek.xyz if you suspect unauthorised access to your account.

4. Gameplay Rules And User Responsibilities

TERRA is built on the integrity of real-world location data and honest user participation. As a user, you agree to:

• Only submit genuine, real-world location data. GPS spoofing, location faking, or use of VPNs to manipulate location-based features is strictly prohibited.
• Only submit original photographs taken by you at the actual task location at the time of submission. Submitting stock photos, screenshots, recycled images, AI-generated images, or photographs taken by other users is prohibited.
• Perform all task activities lawfully, safely, and without trespassing on private or restricted property.
• Not create multiple accounts to farm rewards, referrals, or invite codes (Sybil attacks).
• Not use bots, scripts, automated tools, or any mechanism that bypasses or simulates human interaction with the Service.
• Not manipulate or attempt to manipulate the XP, multiplier, or reward systems by exploiting software bugs, race conditions, or unintended system behaviour.
• Report any suspected bugs, exploits, or unintended reward mechanisms to support@terraseek.xyz rather than exploiting them.

5. Place Minting

The place minting feature allows users to claim unique geographic locations on the TERRA platform by paying a fee in SOL. The following rules govern place minting:

• Each geographic location can only be minted once. A 50-metre exclusion radius around each minted place prevents duplicate claims.
• SOL payments made to complete a mint are processed on-chain and are non-refundable once confirmed by the Solana network.
• TERRA does not guarantee that any particular location will remain available for minting at any time.
• Minted places confer in-platform status and rewards as described in the current game rules. They do not confer any real-world property rights, easements, or legal interest in any physical location.
• TERRA reserves the right to modify, remove, or reassign places in cases of abuse, technical necessity, or legal requirement.

6. SKR Token And Multiplier System

SKR is a utility token used exclusively within the TERRA ecosystem. The multiplier system allows users to amplify their XP, task point, and SKR reward rates by spending SKR tokens.

• SKR tokens have no guaranteed monetary value and should not be treated as an investment.
• SKR token transfers for multiplier upgrades are on-chain transactions that are irreversible once confirmed.
• The pricing, availability, and reward parameters of the multiplier system may be modified by TERRA at any time to maintain platform balance.
• TERRA does not guarantee any minimum return on SKR tokens spent for multiplier upgrades or any other in-platform purpose.
• Acquiring SKR tokens for resale or speculation outside the platform is done entirely at your own risk.

7. Referral Programme

• You may invite other users to TERRA using your personal invite code. Referral rewards are credited when invited users complete qualifying actions as defined by the current reward rules.
• You must not distribute invite codes through spam, misleading advertising, or in ways that violate the platform rules or any applicable law.
• TERRA reserves the right to withhold, claw back, or cancel referral rewards if the referral was obtained through abuse, fraud, or violations of these Terms.
• Reward structures for the referral programme may be amended at any time.

8. Prohibited Conduct

In addition to the gameplay rules above, you must not:

• Use TERRA for any illegal, fraudulent, or unauthorised purpose.
• Attempt to probe, scan, or test the vulnerability of the platform, its APIs, or any related infrastructure.
• Circumvent, disable, or interfere with security features, rate limits, or access controls.
• Harvest, scrape, or extract data from the platform beyond what is reasonably needed for personal use.
• Introduce malware, viruses, or other harmful code into the platform.
• Impersonate TERRA, its team, or other users.
• Engage in any conduct that disrupts the Service or degrades the experience for other users.
• Attempt to access accounts, systems, or data belonging to other users.

9. Intellectual Property

All content, software, branding, UI designs, game mechanics, and documentation on the TERRA platform are owned by TERRA or its licensors and are protected by intellectual property law. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purposes only.

You retain ownership of any original photographs and content you submit through the platform. However, by submitting content, you grant TERRA a worldwide, royalty-free, sublicensable licence to use, store, process, display, and analyse that content for the purposes of operating the Service, including AI-based task verification.

10. Blockchain Risks And Transaction Finality

You acknowledge and accept that:

• Blockchain transactions are irreversible. Once a transaction is confirmed on the Solana network, it cannot be reversed or refunded by TERRA.
• Network fees (gas fees) paid to validators are non-refundable regardless of transaction outcome.
• Blockchain networks may experience congestion, downtime, or technical failures beyond our control that affect transaction processing.
• The value of SOL and SKR tokens fluctuates and may become zero. TERRA does not guarantee any token value.
• Smart contract bugs, exploits, or protocol changes on the Solana network could adversely affect your assets, and TERRA accepts no liability for such events.

11. Disclaimer Of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT ON THE PLATFORM.

12. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TERRA AND ITS OPERATORS, EMPLOYEES, CONTRACTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, DIGITAL ASSETS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE FEES YOU PAID TO TERRA IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

13. Indemnification

You agree to indemnify, defend, and hold harmless TERRA and its operators, affiliates, employees, and contractors from and against any claims, liabilities, damages, losses, judgements, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or third-party rights; or (d) any content you submit to the platform.

14. Termination And Suspension

We reserve the right to suspend or terminate your access to the Service, with or without notice, at our sole discretion, if we believe you have violated these Terms, engaged in fraudulent or illegal activity, or posed a risk to the platform or other users. Upon termination, your right to use the Service ceases immediately.

You may cease using the Service at any time. Provisions of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and dispute resolution) shall survive.

15. Service Changes And Availability

TERRA is an evolving platform. We may at any time and without prior notice: modify, suspend, or discontinue any feature or the entire Service; adjust game mechanics, reward rates, level thresholds, or token economics; introduce new requirements or restrictions; or perform maintenance that temporarily limits access. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

16. Third-Party Services And Links

TERRA may integrate with or link to third-party services, including Solana wallets, blockchain explorers, and infrastructure providers. These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, practices, or reliability of any third-party service, and links do not constitute endorsement.

17. Governing Law And Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable law. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation by contacting us at support@terraseek.xyz. If a resolution cannot be reached within 30 days, the dispute may be referred to binding arbitration or a court of competent jurisdiction as required by applicable law.

Nothing in these Terms limits your statutory consumer rights in your country of residence.

18. Entire Agreement And Severability

These Terms, together with our Privacy Policy and Licence, constitute the entire agreement between you and TERRA regarding the Service and supersede any prior agreements. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
